Megasol AG (hereinafter “Megasol”) respects the privacy of every person who uses our products and functions. 

In this privacy policy, you will find out what personal data we collect, for what purposes we collect this data and what we do with the data we collect. The security of your data is therefore our top priority. Our privacy policy explains:

The protection of your data is important to Megasol and therefore, whether you are a new or long-time user, we ask that you take the time to familiarize yourself with our practices - if you have any questions, please contact us.

1. Processed personal data

As part of our business relationship, we regularly process the following categories of personal data: 

  • Personal master data (e.g. title, first name, surname, gender, customer number, user name);
  • Contact information (e.g. billing, residential / delivery address, e-mail address, telephone number);
  • Content and marginal data of the communication (e.g. information on type, time or, if applicable, place of communication). 
  • Behavioral and transaction data (e.g. shopping cart details, shopping behavior, participation in events, information on subscribed services); 
  • Financial data (e.g. payment details, credit information); 
  • Customer history (e.g. interaction with customer service, information on the handling of defects or complaints). 
  • Online identifiers (e.g. device identification data, IP addresses); 
  • Online tracking and traffic data (e.g. surfing behavior, click behavior when receiving newsletters); 
  • Profile data or personal preference data (e.g. preferences in relation to products or services). 

First and foremost, we process personal data that you transmit to us or that we collect when operating our websites. This may involve all of the categories of data listed.

2. Contract fulfilment

We need to process your personal data so that we can conclude and process contracts with you. This is the case, for example, when you place an order, register for the web store or make use of other online and offline offers from us. For the purpose of fulfilling the contract, we can carry out all processing that is necessary for the initiation of the contract, the conclusion of the contract, the execution of the contract or the enforcement of the contract.

3. Communication

In order for us to communicate with you and respond to your concerns, we need to process your personal data. This may be the case if you use one of our contact forms, contact us by email, post or telephone or in any other way when we contact you, or for customer care purposes.

4. Marketing and Information

We may process your personal data for marketing purposes so that we can make you attractive and suitable offers and send you interesting information about products, services, events, etc. You can unsubscribe from marketing communications at any time. You will find a corresponding unsubscribe link in the e-mail communication.

5. Profiling

In some cases, your personal data is processed automatically in order to evaluate certain personal aspects. We use such evaluations in particular to provide you with targeted information and advice about certain services or products from us. For this purpose, we use evaluation tools that enable us to communicate in line with your needs and take appropriate advertising measures, including market and opinion research.

We may also process your personal data for other purposes. These include:

  • Market and opinion research; 
  • Assertion of or defense against legal claims; 
  • Other purposes (e.g. administrative purposes, such as the management of master data, accounting, data archiving and the testing, management and ongoing improvement of IT infrastructure) and the evaluation and improvement of internal processes. This also includes, for example, analyzing the usage behavior of our website to optimize it. The protection of other legitimate interests is also one of the other purposes, which cannot be listed exhaustively.

We collect information to provide better services to all our users - from identifying basic aspects such as the language you speak to more complex issues such as energy consumption (electricity, water, gas, heat). We collect information in the following ways:

You can visit our website without having to provide any personal details. We store your access data without personal reference.

9. Log data

However, when you access content provided by Megasol, we collect and store certain data in server logs. These logs contain, among other things: 

  • Details of how you have used our services.
  • IP address 
  • Data on device events such as crashes, system activity, hardware settings, browser type, browser language, date and time of your request and referral URL
  • Location-related information 

Local storage: We may collect and store information (including personal data) locally on your device using mechanisms such as your browser's web storage (including HTML 5) and application data caches.

Our partners and we use various technologies to collect and store data when you access a Megasol service. This may include cookies or similar technologies that identify your browser or device.

11. Types of cookies that we use

Most of the cookies we use are so-called “session cookies”. They are automatically deleted at the end of your visit. Other cookies remain stored on your end device until you delete them. 

  • Necessary: These cookies are essential for the website to perform basic functions and for the website to function properly.
  • Performance: These cookies collect information about how you use our website, e.g. which pages you have visited and which links you have clicked on. None of this information can be used to identify you.
  • Functional: These cookies enable the website to provide enhanced functionality and personalization.
  • Advertising: These cookies are used to deliver advertising that is relevant to you and your interests.

12. Manage cookie settings

You can change your cookie settings at any time by clicking on the “Cookie settings” button. This allows you to call up the cookie consent banner again and change your settings or revoke your consent immediately. In addition, different browsers offer different methods for blocking and deleting cookies used by websites. You can change your browser settings to block/delete the cookies. 13. Analysis

To enable a statistical analysis of user behavior, Megasol uses analysis services and tracking technologies from Google, Mountain View, California, United States. The data collected in this way is anonymized. Only how Megasol products are used is recorded, e.g. page views and loading times, but never personal or customer-identifying data or content. The data collected in this way is used exclusively for troubleshooting and optimizing the customer experience. 14. Google Hosted Libraries

Google Hosted Libraries is used as a CDN (“Content Delivery Network”) to secure the Megasol servers and optimize loading times. Here you can find information on security & data protection at Google Hosted Libraries.

15. Contact forms

If you use the contact and registration forms offered on our website, you should not enter any sensitive or particularly sensitive data. Information that is transmitted via the Internet (such as online forms) and content received online may be transmitted via third-party networks and may be visible to anyone.

16. Visiting our social media channels

We have embedded links to our social media channels on our websites. This is visible to you in each case (typically via corresponding icons). If you click on the icons, you will be redirected to our social media channels. 

In this case, the social media providers will know from where you are accessing the network. The social media providers can use the data collected in this way for their own purposes. We would like to point out that we have no knowledge of the content of the transmitted data or its use by the social media providers.

17. Emails

You have the option to unsubscribe from further product information or e-mails in every e-mail from us. This does not apply to emails that are necessary for the customer relationship or its termination, e.g. updates to our General Terms and Conditions (“GTC”). We use systems from The Rocket Science Group LLC d/b/a Mailchimp (brand name “Mailchimp”), among others, to send emails. Your first name, last name, country, language, company and, if required, information about your customer segment are transmitted to Mailchimp for processing. 18. Disclosure of your personal data

We may need to use the services of third parties and commission them to process your data (so-called processors). We contractually ensure that processors comply with data protection requirements and treat your personal data confidentially. The categories of recipients are as follows: 

  • Accounting, fiduciary and auditing companies;
  • Consulting companies (legal advice, taxes, marketing, communication, etc.); 
  • IT service providers (web hosting, support, cloud services, security, backup storage, fraud prevention, etc.); 
  • Payment and collection service providers; 
  • Shipping and logistics; 
  • Event organization; 
  • Advertising and marketing (e.g. for sending communications such as mailings, postcards, newsletters and reach measurement, display advertising, handling of competitions, surveys and market research); 
  • Provider of tracking services, conversion measurement, user analysis, content delivery, web design, etc 
  • Partner companies. 

 

Our service providers may also process data about how their services are used and other data that arises in the course of using their services as independent controllers for their own legitimate interests (e.g. for statistical analysis). The service providers provide information about independent data processing in their respective data protection declarations. 

We may also be obliged to disclose your data to authorities in Switzerland and abroad (e.g. as part of investigations, proceedings or due to legal obligations). These authorities process your personal data under their own responsibility.

19. Disclosure to subsidiaries

We share company software with our subsidiary. This means that our subsidiaries can also view all of Megasol's customer data. Every Megasol customer consents to this processing. Our subsidiaries are obliged to maintain confidentiality with regard to the use and your personal data.

20. Specific third-party providers

Personal data may be stored in third-party systems in order to use the technical or organizational services of third parties that we require for our business activities. For example, surname, first name, company, language, address, information on the customer segment and bank details in our business software from Comatic AG AG, Sursee, Switzerland. We use business tools from Google Workspace (Google, Mountain View, California, United States). We also store personal data in these tools, such as e-mail addresses. You can find out more about Google Workspace's privacy policy here.

21. Disclosure of personal data in the event of corporate restructuring

If Megasol is involved in a business combination, acquisition or sale of assets, we will continue to ensure the confidentiality of any personal data. In this context, we may share your personal data as part of a due diligence process. Whenever possible, this will be done anonymously. Due to the confidentiality of such processes, you will not be informed separately. Should a transaction take place, you will be informed promptly by Megasol or the acquiring company about the change of the responsible data processor. 

Transfer of personal data abroad 

As far as possible, we process your personal data in Switzerland or the European Economic Area (EEA). Under certain circumstances, your personal data may be transferred to service providers abroad as part of order processing. In exceptional cases, the transfer may take place worldwide. 

Data will only be transferred to a third country in the absence of adequate data protection in the third country concerned if we have agreed suitable guarantees with the recipient to ensure data protection (see standard contractual clauses for the transfer of personal data to third countries). A transfer based on standard contractual clauses only takes place after a prior risk assessment. If the risk assessment shows that the recipient cannot comply with the standard contractual clauses, we will ensure that additional technical measures are taken to safeguard the integrity and confidentiality of the personal data transferred.

22. Scope of application of the privacy policy

Our Privacy Policy applies to all services offered by Megasol. This Privacy Policy does not apply to services that are covered by separate privacy policies that do not include this Privacy Policy. 

Our Privacy Policy does not apply to services offered by other companies or individuals that may include Megasol services or other websites linked to our services. Our Privacy Policy does not cover the handling of information by other companies or organizations that advertise our services.

23. Your rights

You have the right to request information about your personal data at any time and, if necessary, to request the disclosure of your personal data. 

Whenever you use our services, we endeavor to give you access to your personal data. If this data is inaccurate, we will endeavor to provide you with options to update or remove it quickly - unless we need to retain this data for legitimate business or legal purposes. 

We strive to provide our services in a manner that protects the data from accidental or malicious destruction. For this reason, we may not immediately delete remaining copies of data that you have deleted from our services from our active servers or remove this data from our backup systems. Please contact us by post or email if you would like information, correction, blocking or deletion of your stored data free of charge. Please enclose proof of identity with your request.

24. Cooperation with regulatory authorities

We regularly review compliance with our privacy policy. Your personal data is stored, processed and forwarded in compliance with the relevant provisions of Swiss legislation (Federal Act on Data Protection) and the EU General Data Protection Regulation (GDPR). The responsible supervisory authority is the Federal Data Protection and Information Commissioner. 

 

Our privacy policy may change from time to time. We will not restrict your rights under this Privacy Policy without your express consent. Any changes to the privacy policy will be published by us on this page. If the changes are material, we will provide an even clearer notice (including, in the case of certain services, an email notification of the changes to the Privacy Policy). We will also keep older versions of this Privacy Policy in an archive for your reference.
